Terms of Service

Please read these Terms of Service carefully before using the services provided by Xiomize Software Pvt. Ltd.. By accessing or using our services, you agree to be bound by these terms.

1. Services

Xiomize Software Pvt. Ltd. provides web design, web development, mobile app development, SEO, digital marketing, and related IT services. The specific scope, timeline, and deliverables for each project are agreed upon in writing before work commences.

2. Project Agreements

All projects require a signed agreement or accepted quotation before work begins. The agreement will specify deliverables, timeline, payment terms, and any other project-specific requirements. Changes to the agreed scope must be approved in writing by both parties and may affect the timeline and cost.

3. Payment Terms

• Payment schedules are defined in the project agreement
• Typically: 50% advance before work begins, balance upon completion
• All payments are non-refundable unless stated otherwise in the Refund Policy
• Late payments may result in project suspension
• All prices are in Indian Rupees (INR) unless specified

4. Client Responsibilities

The client is responsible for:

• Providing accurate project requirements and timely feedback
• Supplying required content, images, and materials
• Ensuring they have rights to any materials provided
• Timely payment as per the agreed schedule
• Reviewing and approving deliverables within agreed timeframes

5. Intellectual Property

Upon full payment, the client receives full ownership of the final deliverables. Xiomize Software Pvt. Ltd. retains the right to showcase the work in its portfolio unless the client requests confidentiality in writing. Third-party components (e.g. stock images, plugins) remain subject to their respective licences.

6. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the project. This obligation survives the termination of the agreement.

7. Warranties & Limitation of Liability

Xiomize Software Pvt. Ltd. warrants that services will be performed with reasonable skill and care. However, we are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount paid for the specific project giving rise to the claim.

8. Termination

Either party may terminate the agreement with 14 days written notice. The client is liable for payment for all work completed up to the termination date. Advance payments are non-refundable unless specified in the Refund Policy.

9. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts in Bihar, India.

10. Changes to Terms

We reserve the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.
